the local magistrates court have passed my fine to phillips for collection £95.
i could not pay this in full as we are on benifits, phillips refused to accept a monthly payment offer from me, i also asked the court fines dept if they could recall the fine and let me pay it off in full or monthly - they refused.
the court told me the comunity legal advice (telephone support and post people) and they may be able to help.
during this time a further £100 was aded by philips for a notice of attendence.
i contacted the comuity legal advice people and they told me they have arrangements with phillips and that they would be able to help, i filled in all paper work and sent it back to them, they told me they were going to deal with phillips on my behalf and that we would wait for a response from phillips about accepting a monthly payment plan. (this was 5 weeks ago and have since not heard anything back from phillips)
now today phillips visited my house again! the put another letter through the door with another £100 added, he stood there for around 20 secs - all caught on my cctv.
i have since rang the community legal people and told them of the vistit, which they said was dishusting, phillips have not even bothered to respond to comuintity legal, they say that they have never recieved any paper work from comunity people, even though the comuinty people say they have faxed them and emailed them many times!!
phillips are total rude scumbags, they are not replying to comunity legal and keep ringing me up (as well as attending today adding a further £100)
the court do not want to no and keep fobbing me off, what can be done to get them to reply to the comunity legal people? how can i complain about phillips, i get incapcity benifit and can not be done with all this hasel!
I can't really offer much advice as I've only had a brief dealing with them, but I know they are regulated by ACEA so it may be worth reporting them to ACEA and OFT and Trading Standards.
If they are calling you ring them up and tell them you want to change your number and give them a fake one, I gave them a fake number as I know that legally we have no obligation to provide them with one, but they refuse to deal with you if they don't have a number and ALWAYS withold your number when you call them. Their number is: 01325 383876, and it saves you calling their expensive line and ending up with more costs. If possible, record all your conversations with their staff as well. All you have to do is tell them at the start of the call you are recording the call, though they will try telling you that you can't, they are lying!
They are nothing more than thugs with a licence to scare and their call centre staff don't know their arse from their elbow (in my opinion). I would contact your local CAB also and advise them what has gone on as they may be able to offer more help and advice.
If you do send them correspondance ensure it is recorded so they can't lie and say they didn't recieve it. I know it's costly but at least you then have proof of when it was delivered and who signed for it, so if it got as far as court, you would have sufficient proof to show you have made the effort to resolve the issue but they have been deliberately awkward.
If at all possible, get your doctor to write a letter to the court stating that the stress and pressure from Phillips is too much for you and is adding to your illness symptoms and causing you further stress. Again this may cost you but may be enough to get the courts to withdraw the account from the Phillips.
Hope this helps and sorry I can't give anymore advice.
i do want to take this matter further and will complain, also the charges are unlawful in my opinion (have had alot of credit cards wrote off because of unforcable aggrements)
its just as its a magistrates fine i know its all different, as im on benifits and have a one moth old child, i think be couuld be classed as vunrable (from what ive been reading)
i just need some one to basicaly tell me what to do and in what order to start my compaints about phillips and hopefully get this recalled by the courts, as i will not be paying any of phillips charges! i have no problem paying the original fine to the courts im not trying to avoid that, but as god is my witness phillips can go f*** them selves and i will do everyhing i can do to make sure they are compained about untill they stop the bully tactics, i need to know what the can charge etc, also the court fine was £95m the court as far as i not awarded any costs to phillips, what happens if i just pay the £95 would phillphs be able to get there charges out of me?
i just need help and advice on the proper way of how to go about this
Unfortunately I'm unsure as to whether the charges are enforceable so you are best off waiting for someone to reply who is in the know. But when it comes to complaining, I can help with that You should start by putting your complaint in writing to Phillips (by recorded delivery) and send a copy to ACEA, OFT, Trading Standards, BBC Watchdog and the Magistrates Court who issued the fine, and ensure you put at the bottom of your letter to Phillips that you have sent a copy to the above people. It may also be worth sending a copy to your local MP, as advised by pink_eeyore. Then wait for Phillip's response, if you are not satisfied continue with your complaint through the above authorities
Chances are Phillip's will try mugging you off and you will have to go through OFT, ACEA and Trading Standards, but its certainly worth it.
I would telephone the court and plead with them to recall the distress warrants from the collection people, I managed to do this recently, tell them you have made an offer of payment but the bailiff refused instalments and also point out that as you are in receipt of benefits the court could have money deducted at source to pay your fine/s
There is no justification for sending bailiffs in when we have attachment of earnings orders available and indeed deductions from benefits.
I explained to my local court that I know they can recall it back to court,
and literally begged them for a hearing. failing this ask the court when the warrant was sent to the bailiff, they have to enforce it wothin 180 days or it has to be sent back to the issuing court, In my limited experience, the smaller amount usually get left until the last minute while they chase after the bigger monies sooner. If the warrant is nearing its time limit it may be worth holding out as the bailiff will usually only get their charges from magistrates warrants if they collect. I could be wrong but all the costs disappeared on mine on 29/June 2009

Am I right?
Yes you are right.
We have recieved a notification, which is being looked into by admin.
They suggest that all customer enquiries be directed through the address given on their website.
More can hopefully be added on this if and when its felt appropriate.

As many people with a Westminster parking ticket or an unpaid Magistrates court fine will KNOW , it is NOT easy to contact Philips and as the original post stated, a Community Legal Service failed to receive a response to correspondence relating to a debtor that they were assisting.
It cannot be nice for Nick Bradley to receive e-mail messages of complaint to his personal e-mail account, but it is hoped that he will appreciate that this was not vexatious......but is a sign of desperation from debtors.

MARTIN.
In considering any response to Mr Bradley, you may wish to note the following extract from a post on MSE yesterday:
I tried to ring Philips and gave up after spending nearly 30 mins in a queue, to be told by the xxxx that answered the phone that they couldn't help in any way whatsoever, and had to transfer me to another department - where the phone queue was again going to be 30 mins or so (I was caller 17 in the queue.....). I hung up..
We are advised by Philips that the email contact details with ref npb has now been de-activated.
I am not surprised that his email has been deactivated, or supposedly, due to the maount of people that will be trying to make contact with him, as the normal route of contact is virually imposible to make contact.
The email address stated was initially copied from the Credit Services Association website, if it was not meant for public use then surley it should not of been made available on the www.csa-uk.com website, i have checked and it has now been deleted from that site.
Whilst i have resolved my problems with Philips direct, i am continuing my efforts to stop future bad practices etc, that Philips deploy, through various channels.
I will of course publish any future Philips email contacts when and if they arise, in the meantime i presume the original NPB email is still active !
Just to add my twopence - I've also been advised about that email address - however, I do have somebody else who seems to be important if you'd like to email -
Dear Mr. xxxxx,
Thank you for your recent email.
Please be advised that your recent request is being looked into and we will be back in touch in due course.
