Cabot Financial Citi Card Default Removal. Help Please.
Hi.
I have an 800£ Default on my credit files (2006). This default was originally placed by Citi Financial and is now in the hands of Cabot.
The debt consists of a 300£ fraudulent transaction and 500£ of charges on a credit card. I haven't paid any of it.
I requested on 14th May for all the relevant info (credit agreement, deed of assignment, default notice, statement etc). Cabot have acknowledged my letter (s) and have agreed to stop chasing me until they can get the info off Citi. They have been unable to get hold of ANY of this information. They are currently refusing to remove the default. As far as I understand it they commit an offence by around 1st July if the documents are not produced and they continue to register a default.
How do I force then legally to remove this default should they not do so by July 1st? I am happy to use the Small Claims court but would love some advice on how to approach it.
I would receive any advise humbly and gratefully.

Having Received No Information From Cabot (not Even A Statement!) I Am Now Taking This To The Small Claims Court. Can Anyone Help With The Particulars Of Claim?

Citi operate in a rather dubious way, their own customers have problems getting hold of copied documents let alone those passed onto DCAs.
I have1st credit recording a default against me, which was unlawfully placed by Citi.... currently trying to tackle that myself and will likely go legal if 1st Credit aren't willing to be reasonable.
Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

Have you contacted the Information Commissioner ? If this amount is made up from fraudulent usage and the charges are in respect of that amount, then they shouldnt be reporting it to the CRAs in your name !

Hi, cheers for the replies. I've just filed a small claims do dah for £1000 (damages relating to a false default). I'll keep you updated. I haven't reported it to the Information Dude because they don't actually seem to have any powers!
