    So here we have a Dormant, Non-trading Company which sends out letters bearing a PO Box address in Liverpool within Barclaycard envelopes carrying a PO Box address in Northampton as a return address.

    In what way is this proper?

    I have been trying to contact Mercers debt collectionautolinker.com autolinking image, Liverpool for days have spent hours on the phone spoken to Mercers in London and Manchester, every department of Barclaycard and Barclaysautolinker.com autolinking image bank were i hold bank account and no one has any contact details for Mercers in Liverpool. I have an old letter from them the contact tel. number is unobtainable.

    The reason for my persistense is some years ago my masterloan fell default and was passed to Mercers an agreement was made and SO set up. I recently realised and i know its stupid but i never cancelled SO they never contacted me again and i have made 12 extra payments.

    Does any one think i will have any hope of getting that money back!!

    Have written to them at Liverpool and also Barclays Bank Head Office, my worry of course is that they appear to be dormant company, I think this is disgusting and more shocking even Barclaycard loans department had or said they had no idea who default accounts were passed over to (what a joke). Anyway i am closing my Barclay's bank account in next week am so disgusted with them.

    I'll move this into your own thread which you can use for your case.

    I assume this is a Barlays Mastercard, in which case, write to Barclaysautolinker.com autolinking image London HQ setting out briefly what has happened and how much you have overpaidautolinker.com autolinking image on the a/c.

    Give them enough info to identify the a/c icluding the a/c no., the card type and your address(es).

    Tell them you require repayment of the amount o/paid within 14 days and send the letter by Recorded or RM Special Delivery.

    Address them as:

    Barclays Bank plc - t/a Barclaycard (or whatever name it was)
    1 Churchill Place
    London

    Thank you for your response, i sent letters rec. delivery on Saturday so will wait for a reply but im not holding out much hope it was a masterloan through barclaycard. The only thing i forgot to do was mention a reply within 14 days. I will keep you updated though.

I have had to phone them every other day have had no written response from mercers at all. Barclaycard and mercers keep insisting they have no idea where money has been paid which is complete poop as i bank with barclays are they really that stupid or is it me

    Shall i write to Barclays HO and complain that if i wanted to make a payment the account would appear out of some where. I have to accept that it was foolish not to keep track and cancel S/O but they should have written to say account payed up in full.

    Hi Angmarie,

    Do you have a thread for this - your post would be better there.

    I'd write to Barclaysautolinker.com autolinking image HO setting out your complaint briefly and tell them they have 14 days to investigate and refund the amount to you direct (they'll want to offset this against your other BC debt).

    If they fail to comply, send a lbaautolinker.com autolinking image and then File a court claim for the return of monies overpaidautolinker.com autolinking image.

    Please confirm which thread this relates to and I'll move these posts.

    Right, I found the original thread that I started for you for this case. Add it to your Favorites so you don't lose it again. I've added the new posts to here so it all makes sense.

    If you have to file a claim against Barclaysautolinker.com autolinking image Bank PLC t/a Barclaycard (which is how you'll name them on a court claim), you should be able to get the money paid to you direct.

    If they agree to refund the overpaymentautolinker.com autolinking image before you file a claim. they'll probably set it against any other BC or Barclays debt. If they do this, I doubt you could argue against it usefully.

    As you say, as long as they don't get to keep it.....

    No probs, except I'm not very good with puters myself.

    I use Internet Explorer (IE7 ?). Open your thread; in the tool bar at the top of your page, L click on Favorites; at the top of the drop down menu is Add To Favorites; L click and the thread you're on will be saved in Favorites.

    You can change the name if you want. When you want any particular thread, L click on Favorites and the faves you've saved will show. L click on the one you want and Bingo - it takes you straight to the thread.

    Use this to save any web pages, etc that you want to revisit.

    Thanks for all your recent help, I phoned mercers today for update on overpaidautolinker.com autolinking image account (hubby's) they are a bunch of useless bones they think its acceptable to say account details been lost, I said pity you couldn't have been so careless 3 years ago.

    Wrote to Barclay's Head Office again, and told them they have 7 days in which to kick ass with mercers or we will have to take this matter further.

    Set out all the payments made in error to Mercers on a site spreadsheet. This would do it - http://www.consumeractiongroup.co.uk...arges-calc.xls

    Narrate each overpaymentautolinker.com autolinking image as "overpaymentautolinker.com autolinking image", enter the date and amount. The spready will be your SOC and, if you file at court, it will calculate the 8% s.69 interestautolinker.com autolinking image which you'll claim. Print off the SOC except for the int't column - you'll use this when/if you file at court.

    Letter as follows.

    Barclaysautolinker.com autolinking image Bank PLC t/a Barclaycard
    1 Churchill Place
    London
    E14 5HP


    Dear Sir or Madam,

    I enclose copies of my letters sent so far. The overpayments arose because payments continued to be made by Standing Order AFTER the debt was paid off in full.

    I now require that you refunds the amounts overpaid to Mercers as per the enclosed Schedule within 14 days.

    Im so excited, I have discovered sort code and account number where S/O payments were being paid to. Its quite disgusting that they have maintained for 4 weeks account details been lost but I feel now as though they have been accepting this payment unlawfully (almost stealing) if the account was settled and closed. Now my point is this if I have discovered these details purely by accident how the hell have my branch, Head office and mercers not been able to find those details. Its quite shocking really and im wondering if armed with the fact ive done their job for them whether i can demand payment to my account, or whether they still have the right to set it against hubby B/C.(they have not mentioned this but its always a possibility). Any comments please.

    Glad to hear you've found this info about where the money was credited.

    Send off the letter as outlined above but don't mention about the a/c details which you now have.

    If they fail to refund or offset against your other BC debt within 14 days, you can file your court claim which wil get you 2 things:-

    1. Repayment made to you direct.

    2. Section 69 Statutory interestautolinker.com autolinking image at 8% on the overpaidautolinker.com autolinking image amounts from the dates they received each one - this is what the spreadsheet calculates for you.

    If they do agree to refund before you file at court, they can only off-set against YOUR Barclaysautolinker.com autolinking image debts or a JOINT bank or card a/c - they cannot set off against a debt in YH's name.

    So fire the letter off asap and hope they don't refund voluntarily.

    Im afraid I was a bit of an eager beaver and had already sent letter containing full account details from: this account to: this account.
    I said to them now armed with full details I fail to see why you cannot refund overpaymentautolinker.com autolinking image to my current account I included details of those just to help them once again, insisting it was refunded in the next 5 days.
    A point I want to raise, and will if they do try and offset against any other barclaycard debt is that how and why would they continue to accept payment against a closed account. I feel that by raising this point they have to return it to where it came from. Will there be any point other than this in which I could argue where refund is paid.

    What's done is done - 'snot the end of the world.

    how and why would they continue to accept payment against a closed account. I feel that by raising this point they have to return it to where it came from.
    Maybe their systems are set up to collect money, not to recognise when it's being overpaidautolinker.com autolinking image - who knows !! You may think they should return the money in this way but they'll see it differently.

    I'd say, if they credit the money against your other debt within 14 days, leave it as a lesson learned.

    I think the 5 days you've given them may not be seen as reasonable. Did you say that court action would be taken without further notice if they don't pay within the 5 days.

    Certainly, if they haven't responded within 14 days, file at court instantly.

    I did not mention filing court claim at all, and I disagree about 5 days given that they have had most of the details since 10th June, Mercers have never even responed to the original letter sent R/D.

    This is why im now dealing with Barclay's H/O, having spent many years working in accounts departments ive never known a system where they dont print monthly accounts out regularly, thats to tell them who's missed payments lol.

    Any hoo lets wait and see what they come back with
