    Default CC Claim against RBoS

    Hi,

    Just about to start a claim against RBoS.

    It's for approx £2000, but that's without the 8% interestautolinker.com autolinking image allowed by courts.

    Not claimed like this for a while and I'm not sure how much the 8% is going to amount to. For example, say I had charges of £100 in 2003, how much interest would that be up to now?

    Has anyone recent experience of calculating the 8% accurately, and can tell me in plain language what to do?

    there is a spreadsheet somewhere which would allow you to do this. It should be in our library.

    In plain language, you will have to do calculate the 8% on each charge from the date it was made up until the present day.

    The best thing to do is to get our spreadsheet and as long as you can put in the charges and the dates they were incurred, then it should calculate all the interest correctly for you.

    However it can become more complicated than that because if the charges have put you into overdraftautolinker.com autolinking image, then the bank will also have charged you interest on those charges. You should claim this fact too. That interest also will be subject to 8% statutory interest as well when you take the matter to court

    I will calculate the interestautolinker.com autolinking image and put my claim into court in a few days, when my wages come in, (prelim letter and lbaautolinker.com autolinking image have long since been ignored by RBoS).

    Hope the process doesn't take long - my last cc claims were in 2006 and were swiftly refunded once they reached the court stage. Has anyone any experience of how long recent claims are taking, before the RBoS pay up? (If they are being successful, that is, for the 'successes forums' seem to be quiet at the mo').

    If this is a bank charges claim then it will more than likely be stayed by the court until the conclusion of the OFT test case. Apologies for not answering earlier but read CC and assumed it was a Credit Card claim.

    Back again . . .

    Finally got round to putting my claim in at my local court. It's for a few grand and includes contractual interestautolinker.com autolinking image and statutory interest.

    It's been over two years since my last claim so I'm wondering if RBSautolinker.com autolinking image are treating claims any differently, i.e. the first time I claimed, they acknowledged the claim and stated they would be defending all of it. Two weeks later they settled! So no court hearing. I'm kinda hoping they will do the same again!!

    Cobbetts have just acknowledged the claim and , once again, state that they will be defending it. Has anyone recent experience of Cobbett's / RBS's tactics?

    They gave me a small, partial refund about a year ago. Since then, obviously, the interestautolinker.com autolinking image on the rest of the charges has spiralled, so they will end up paying more than they would have, stupid really!

    Looks like RBoS are going to defend this one. . .

    In their defence, received last week, they are saying that their 'charges' are not 'charges', but,

    'payment for services provided by the defendant'.

    So how can charging £20 for an overlimit fee or late payment be a service?!

    What are they 'providing' me with for this 'service' ?

    Anyone any suggestions how to counter such an absurd idea???

    RBSautolinker.com autolinking image have offered a partial refund.

    I don't want to accept such a low offer but I am prepared to accept a fair settlement.

    Has anyone any experience of RBS's stance on a bit of negotiation?

    Are they likely to say, 'That's your offer, take it or leave it' or do they actually negotiate?
