Unhappy BOS - Scottish Law Issue - PLEASE HELP !

Hi PLEASE HELP
I have filed a claim against the Bank of Scotland NOT RBOS. I have got to the stage of commencing court proceedings. When I filed online through moneyclaim they sent acknowledgement letter to me but under separate cover, sent me the defence claim form from the court for BOS. I contacted them as I assumed this should have been sent to BOS as they are the defendant and they informed me the address I entered was incorrect. I have used a scottish address (600 Gorgie St) and they have informed me that I should use a local branch address (in England) as the law is different in Scotland. However, they advised that should the form come back again, they cannot help me further.

Does anybody know what to do at this stage? Has anybody experieced this 'Scottish law being different issue' ? I have now sent the claim form to my local branch but they have said that the BOS's in England are now Halifax.

Any help would be appreciated. THANK YOU

Firstly this should be in the Halifax/BoS section... http://www.consumeractiongroup.co.uk...bank-scotland/

But in answer to your question although the law is different in Scotland you are in England and come under English/UK law.

Just because the BoS HQ is in Scotland is still immaterial as Scotland is still in the UK. I used the Scottish HQ address for the RBoS and there has been no problem.

Some courts insist that you add a few lines of wording to the PoC on the N1 saying, in effect, that you won't sue the BoS under Scottish law as well, but I wouldn't worry about it if I were you.
