Hi,

Have started this a side thread to my legal issues one regarding this account (if interested, http://www.consumeractiongroup.co.uk...ard-cohen.html)

Sent off an Subject access requestautolinker.com autolinking image to Santander in order to obtain all documents relating to this account and obviously the original application appeared (below). It clearly shows that PPI (or "Account Cover" as it was called here) was not requested yet, in 2007 there is a note on the account showing that it had now been applied. Surely a signatureautolinker.com autolinking image is required for this??

In short, this does not seem to be proper and as such am I right in assuming that we should be able to claim these sums back? If so, how do we go about it?

Very Naughty.
When I Was In Retail We Were Pushed To Sell Acct Cover And If We Didn't Sell The Targeted Amount In A Month We Would Be Held To Account If That Happened Again We Could Get Fired.
What Has Happened Above Is Someone In The Store Accts Office Has Just Rung The Acct Through Actioning The Acct Cover.
Is That Not Fraud,can The Office Asst Not Be Repremanded.

I had no problem receiving pay out on my Dorothy Perkins storecard run by Santander as this was opened post 2005. However they have refused on my Frasers card. Same circumstances - pushy sales person with no financial training. The reason I understand is cos the FLA who deal with pre 2005 claims are useless. I am going to raise a court action as I reckon they cannot justify repayment on one card and not on the other when the circumstance surrounding the complaints are identical.

In my case (well my OH's) the agreement has the typed instruction 'account to be set up without account cover', yet he was still charged for PPI which we only recently realised

Have to agree with Gamba's comment about the FLA - totally pointless waste of time..............
