| halifax passes corrospondence to legal team hello ,have sent 2 recorded delivery letters to the halifax giving them 7 days to sent cheque to me after their last letter awarding me £4000 plus, but they where sending it to DCA within 28 days, i sent them a copy of the statement i got of them saying the account was repaid and a strong worded letter , today got reply thanking me for recent correspondence and it had been passes to their legal team and where awaiting comments and would respond within 21 days and thanking me for my patience from the 6th or 7 th customer relations manager i have dealt with. any advise please  |

You should be sure to send copies of all correspondence sent and received so far. This will enable the Ombudsman to at least have an idea on your side of the PPI issue. The FOS should then ask halifax to present its case and then the adjudicator or ombudsman will make a decision. You must be aware that the FOS are upholding about 90% of complaints so you should stand a good chance of success.
Make sure you speak to them first and in fact they will always call you back to save your phone bill. Give them as much information as possible and always keep spare copies of everything you send.
The FOS route takes time but the only cost will be your postage to the fos and any copying costs. It will however cost the halifax £500 for the FOS investigation.
You may even consider writing to halifax to let them know your intended actions.

Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI. |

If you need further advice remember CAG has many forums not just PPI but legal, Debt, even parking and shopping

thank you alanalana, this present loan for ppi is about 2004,so the original one 2002 or 2003, does anyone have a letter or advise on the line i should take to the halifax while they um and ar for the next 21 days as to who gets my ppi award , me or DCA . they will be looking over the statement THEY sent to me saying in black and white ,that the account has been paid in full thanks | If you have all the copies of your consumer credit agreements then ask for a full refund of all PPI premiums you have paid and insist the refund is paid to you by way of a personal cheque. You are claiming back the PPI as mis-sold with the loan so any rebate/refund should NOT be used to pay off any arrears on the loan to the DCA.
