Hi

I recently sent an Subject access requestautolinker.com autolinking image request and got all information back.

I honestly can't remember taking out PPI but they have a screen print shown on the bottom of the text box with it ticked.

It really looks like this box was copied and pasted onto the bottom of my application as it is completely out of line with the box above!

Has anyone else experienced this?

Thanks greatly in advance for any help on this matter.

they have to prove you requested PPI, not you have to prove you did not.

Thanks for your reply,

So basically reply saying I did not request PPI and I would like "X" amount back which was charged under PPI.

If no reply, I will take the matter to the small claims court.

Is that the correct course of action? Has anyone else had a similar situtaion?

I had the same with Egg and a loan I had on-line. i don't remember ticking the box but I think when I took it out in 2004 it was pre-ticked and you had to untick the box. On those grounds I have sent it to the fosautolinker.com autolinking image. Ombudsmanautolinker.com autolinking image really busy and it has been with them since beginning Feb this year. I have seen on the forums that it is a long wait but I am quite happy to wait.

PPI complicated issue due to the variations ie secured/unsecured loan, Credit card, store card, car loan, mortgage some by mail or visit to bank/building society, a lot on line with electronic ticks in boxes or failure to untick preticked boxes. PPI is a minefield and better to research before action.

Use the stickies and follow other threads to get the general feel for the way ahead. Could be a long road but worth it

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement

PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. They have now been given a deadline before FOS action. No response so complaints now with ICO and FOS.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
