Question Overview

Hi All

I am completely new to this whole concept since finding out about unenforceable debt earlier today. Forgive me if I am not using the correct protocol.

I have two loans commenced prior to 2007 (I understand that those commenced after are not relevant?) and two credit cards. Total debts of around £43000. I am not being hounded for payments and all are up to date, for now.

I am trying to get my head round this subject and having spent the last 4 hours on the forums, I am a little dizzy!

Could somebody just outline the issue of unenforceable debt and the stages I could expect to go through. From what I can see, the starting point is the letter requesting all documentation from the lender, refering to CCA. Once this is supplied, is it then a question of legal view/court action to try and get the debt written off, assuming the intial docs are deficient in some way?

Is there ever a chance of clear cut way forward or more so persuing legally through to conclusion? Are there standard letters to be sent?

One of my loans is a Cahoot Flexible Loan, started at around 7% now charged at 17.9% since Aug 08, and not moved since base rate has reduced. Is this part of the unenforceable issue or rather unfair chargesautolinker.com autolinking image?

Confused. Happy to persue, but I just need to assess the size of this project oppossed to getting direct legal assistance.
