| | Basic Account Holder | Help Needed Please ***WON*** Hi,
Been on holiday and got back yesterday to a letter from the local county court stating that the 'directions' will take place on Tuesday 10 July by way of telephone conference. Eeek!!!!
Now with it being a telephone conference am really worried about what to say etc. Also it says the defendants legal representative is ordered to arrange it but he hasn't been in contact by letter and no messages on my answer phone- what shall i do about this???? Do i need any paperwork??? Arrgh- could do with more time to prepare. Was hoping i wouldn't go as far as this but it looks like my claim is going alll the way.
Please help.....i'm worried

DON'T PANIC!
If Barclays' crew have been ordered by the court to do something, and they haven't, then they will be in trouble with the court, not you!
A directions hearing is for the judge to decide how the case will proceed from now on. Check out http://www.consumeractiongroup.co.uk...ate-guide.html for information on what you might need to have handy.
and most importantly, DON'T PANIC!
It might be a good idea to ring the court on Monday morning to clear up any queries you may have.
and remember.....

Thanks for the reply, will take a look. Bugger, i thought that it would be over with after tues and i would either have won or not. Didn't realise it was only to see what happens next.

Very last minute but if you email Dino on the Litigation team on Monday telling him the Directions hearing is on Tuesday, they may agree to settle immediately and email you an offer letter. Send him your Court Claim No. and your SOC and ask Dino to phone you.
Have an up-to date SOC (Schedule of Charges) with you that includes your full claim, s.69 interest to date plus your Court Fees so you can confirm the precise figure you want B's to offer.
If that works, attend Court, tell the judge they've offered to settle in full and ask for a short adjournment. When they settle, you can tell the Court and discontinue your claim.
If Barclays don't offer on Monday, go to Court and see what Directions the Judge orders. No idea what the phone conference means - never heard of it but maybe someone else here has.
And don't panic (easy to say!). The Court is expecting the defendant to arrange the phone conference, not you.

Of course, if they should ask what type of hearing it is, then you'd have to be truthful, but I got full settlement a week before my PRELIMINARY hearing!  |

You've done nothing wrong and it's not for you to sort out the phone conference, whatever that may be. The Defence legal rep was ordered to do it.
If no reply from B's, you go to the hearing and report what happens back here.

Which court are you at? I'm at Hitchin and have had no luck getting through to Barclays either regarding the settlement or the telephone conference set up.
I'm wondering if they know when it's an allocation hearing and just ignore it. I had an email from Dino last Tuesday saying he'd talk to Paul Quinn about it as I'd tried getting in touch for weeks but still nothing, even after another follow up today.
Hope it goes OK tomorrow. I'm sure it will. I'm pretty sure the judge will be annoyed that they haven't played their part. Not sure what he'll do about it though I'm afraid.

| Re: Help Needed Please Sorry for the poor response- i was busy trying to get my final bits ready for today. It was at Keighley court in West Yorkshire
BUT
At 9.45am this morning i had a missed call and a voice mail from a nice chappy called Paul Quinn asking me to ring him back....Dino was apparently ill yesterday hence the no response.
Anyway, I got hold of Paul straight away who just said that Barclays would like to settle in full!!:o
He emailed me a offer which i've signed and faxed back (crossing out the cofidentialty clause).
I let the court know but just hoping i haven't made a boob coz money is not actually in my account BUT i do have the letter and all correspondence so they can't rip me off!!!
Anyway thanks for all the help- couldn't have done it without you all.
Will be donating to CAG
