best think they could do is make a policy of how to deal with such claims, thus eradicating the courts costs, it would make everyone happier surley !

Of course, but then for every 1 that sees it through, there's probably 10 that get scared off when the bank defends.

In fact, I have done it - I threatened Barclaycard at the beginning of this year and I haven't followed through - they have completely ignored me. I fully intended to do so, then this site picked up considerably and I ran out of expendable time. However, I WILL be starting legal action soon; I just have to find the 35 mins to go through the statements and start the claim.

From their point of view this action of theirs is cost effective - if we can change that, then we have a glimmer of hope.
