Default me v Barclaycard 1

Have just received 6 yearsautolinker.com autolinking image of statements on 1 of my OH's barclaycards following Subject access requestautolinker.com autolinking image and then complaint to Information Commissioner`s Office as they did not respond. I want to submit a claim for charges on the card going back 6 years. Can I claim the cash adv/chq handling fees? as well as late payment fees.

Already have a post in PPI forum for claiming mis sold PPI.

On statements for no2 card there is a charge each month for "accidental death insurance" as well as ppi. My OH has no recollection of asking for this, so want to claim these premiums, at charge + compund + 8%. Which interestautolinker.com autolinking image rate do I use for the compound calculations, transaction rate or cash rate? Am already preparing a claim for mis sold ppi on this card.

Hi Dj,

As with PPI, any claim for refund of Ins'ce Premiums should be d/w separately from a claim for refund of charges.

You will have to file a claim if you are claiming interestautolinker.com autolinking image at the higher rates as BC will refuse to repay voluntarily. They'll only negotiate at the last minute, just before a final court hearing for the case.

Just a quick update. Submitted claim to barclaycard 09/07 stating we believe this policy was mis sold as was never requested and no recollection of authorising the policy to be added to account.

Received letter dated 30/07 stating accidental death insurance scheme is administered by Stonebridge insurance and we should contact them direct. Phoned Stonebridge and they confirmed this, so submitted claim for mis sold policy 19/08 to Stonebridge. Their address is;

Will update as things develop.

Hi dj,

I thought this sounded odd, so have taken advice from other members of the Site Team.

They agree that it is BC who (mis)sold the PPI on your a/c and it therefore BC who should d/w your complaint. Go back to BC and insist that it is THEY who must d/w your complaint.

Otherwise you could get passed from pillar to post, ad nauseum.

Thanks Slick,
I did think of this so phoned Stonebridge insurance when OH received letter from barclaycard, who confirmed it is they why would investigate any complaint of mis selling.

Went on to say it was highly unlikely that OH would have been unaware of the policy as they have procedures in place to ensure the customer knows exactly what the policy is for including no less than 3 advisers calling OH on 3 seperate occasions to ensure she was happy to go ahead with the policy.

I told him his assurances and policys meant nothing to me and wanted them to investigate, then provide copies of these alleged telephone conversations, none of which were provided in our DSAR request.

While I suspect you are right, am willing to hang tight for them to investigate and see what comes out of that before considering next course of action.

My concern is that they will investigate and come back with any number of reasons as to why the PPI is, in their opinion, correct.

You will then have to take the matter up with BC anyway, and will just have wasted time waiting.

Completely forgot about this one.

As you suggested Slick, we were passed from pillar to post on this one, never actually getting anywhere.

In part that is my fault for not keeping on top of it, but with all other claims for ppi and charges on cards either settled or with the fosautolinker.com autolinking image I think it is time to resurrect this one.

Any suggestions on wording of letter I should send to barclaycard?

Just to recap, complained to barclaycard, they replied saying stonebridge sold the policy and we have forwarded your complaint. Stonebridge did write back saying the policy was sold ........ OH called to add mother as beneficary on ........... I asked for copy of transcripts of alleged conversations last October, never heard anything since.

Would appreciate any advice.
