Default whats next?

hi, i have sent a letter a cheque to barclaycard to get my agreements and statements to claim back my money and read somewhere to allow 40 days, its been 40 days and had nothing although the cheque has been cashed whats my next step??

If you sent a Subject access requestautolinker.com autolinking image and its been 40 days you can either send a letter to barclaysharks reminding them of there obligations or go direct to the Information Commissioner`s Office and make a complaint.

Link HERE Click on the "by email" link at the bottom and enter in the required details. They are running about 2-3 weeks before sending out acknowledgements by letter although you should receive an email confirmation sooner than that.

If you have asked for the agreement etc. Under s77/78 CCA 1974 then you should have received a reply within 12 + 2 days (allowing for postage)

If no reply is received within that timescale then they have not complied and you can then 'dispute the account' for non compliance.

If however you requested the documents under the DATA Protection Act then you follow the course that Shadow has suggested.

Depends which act you used to request the info as to which course of action you now take.

Guessing it's a Subject access requestautolinker.com autolinking image as Kredda refers to the 40 days.

Although the Subject access requestautolinker.com autolinking image will include, amongst other things being asked for, the credit agreement, only statements will be sent out in response.
