Default Barclaycard Debt

Hi, I am new to this site and wonder if anyone can give me some advise please?

I have an outstanding ballance with Barclaycard and up until the end of last year I was paying it through the CCCS while being on a Debt Management Plan with them. Unfortunately the agreement came to an end as I was made redundant and no further help was received by the CCCS. I have now decided to do the Debt Management by myself and so far all of my Creditors have accepted my proposal apart from Barclaycard.
They told me that they can't accept the amount I have offered them and that the minimum I need to pay has to be 1% of the outstanding debt but if I were to use the CCCS or any other Debt Management Company they would accept my proposal. To me this doesn't make any sense at all and now I am being harrassed by Mercers who are threatening to send somebody to my house.

DUH! When you said Barclaycard, that should have given me a clue Don't worry, I put it down to senior moments.

If it is an old account it may be worth sending a CCA to see if the had a valid agreement with you however, if you have lots of charges on your account, it would be worth sending a Subject Access Request to Sharkleys. These charges, you could reclaim.

Letters 8 and 11 are the ones I would go for.

Golden rules of CAG.
Never speak to them on the phone (unless you can record the call)
Everything in writing
Never sign CCA requests
Everything recorded delivery.

If you send a Subject Access Request, they tend to ask for your signature so try to make it so it can't be "lifted" (put a couple of lines through it or sign on a coloure background)

Thank you Fox. I will be doing those letters as soon as possible. I am so glad that I found this site, I was starting to really loose my marbles with all the worrying. Even my little girl asked me why I always look so sad and don't smile anymore. But I am glad that I can share these things now and get help in dealing with this situation.

Start smiling- you've found CAG!

I've seen Sharkleycard off twice using info from this site.

Send off for list of statements, Im sure you have charges which can be reclaimed- do realise that you can reclaim all the interest theyve added due to these charges as well!! This can amounts to many times the actual amount of the charges!

What about PPI - payment protection insurance? Did you take this out?

If so, most likely it was mis-sold to you, so you can get back all premiums and interest on the premiums back as well!

This should reduce significantly or even cancel your balance out entirely.

There are loads of ways to take Sharkleys apart. Ive done it, with the help of CAG.

First off- send Subject Access Request for all your statements and CCA for copy of your agreement.

Dont worry about the agreement -THEY ARENT WORTH A XXXX!

You would also be very wise to send them a Subject Access Request for copies of all your statements.

These will contain all the info you need to reclaim/remove all overlimit/late payment charges and mis-sold PPI premiums and the unlawful interest they have scammed you into believing you owe them.

Thank you Noomill, yes I will be sending them the Subject Access Request as well. The only concern I have is that I sent in May a letter to all of my Creditors with regards to a payment plan that also included my financial statement and I signed those letters. I wasn't aware at the time that I can do what I am doing now and I am wondering what the possibilities are of them using my Signature from those letters?
