Please try not to worry and get upset, I know its hard we've all been there but you've come to the right place to get lots of help.
Is this debt on a mortgage, loan or credit card?
Theese people are all the same threat after threat after threat, it's their way of putting pressure on you, scare tactics, all in the hope that you will pay more (people try to get additional loans to pay them off without realising its getting them more in debt) These people, and I use the term loosely are the lowest of the low.
Regarding the
phone calls
you could send them the telephone harrassment letter and state all communication must be in writing.
Do you have the means to record your conversations, if not make a note of the date and times they ring. Rule is DONT SPEAK TO THEM ON THE PHONE ALWAYS IN WRITING.
Why do you have to phone them to make the payment, its another way to put pressure on and threaten you, get someone to go into a branch for you (or go yourself and when they ask are you he, just say no) and pay it over the counter.
Court is a way off (if at all) its just another threat in the hope that they panick you into paying what you can't afford to do at the loss of paying another bill off. We on the forum will help you every step of the way.
CAB as you say may be able to help you they are very good or speak to the National Debt Helpline.
You could send the following letter to them:
Harassment by telephone
Account Number: XXXXXXX
I am writing in relation to the quantity and frequency of
telephone calls
that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls. (delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Be advised that any further
telephone calls
from your company will be recorded. (Even if you don‘t yet have recording equipment!)
